GENERAL TERMS AND CONDITIONS (GTC)

for Digital Content & Online Courses

1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts concluded between Marie-Sophie Kiepe (hereinafter “Provider”) and consumers (hereinafter “Customer”) for the provision of digital content and online services via the website: www.mariesophiekiepe.com

2. Services
The Provider offers digital content in the form of online courses, live sessions, recordings, and accompanying materials.The specific scope of services results from the respective course or service description.The content is provided for educational purposes. No specific success, outcome, or individual result is guaranteed. The services do not replace medical, therapeutic, or psychological treatment.

3. Conclusion of Contract
The presentation of services on the website does not constitute a binding offer.By completing the booking process and confirming payment, the Customer submits a binding offer.
The contract is concluded upon acceptance of payment by the Provider.The contract details are sent via email. The Customer must ensure the accuracy of their email address.

4. Prices and Payment
All prices are stated in Euros and include applicable VAT where required.Payment is due immediately upon booking.Payments are processed via the available payment providers (e.g. PayPal, credit card). Additional fees (e.g. foreign transaction fees) may apply depending on the Customer’s provider.

5. Access and Provision of Content
Access to digital content is provided via an online platform (e.g. video streaming or membership area).Access is granted after successful payment.Unless otherwise stated, access is limited to the duration specified in the respective offer.The Customer is responsible for ensuring the technical requirements necessary to access the content.

6. Usage Rights
All content provided (videos, materials, recordings) is protected by copyright.The Customer receives a non-exclusive, non-transferable right to use the content for personal purposes only.It is not permitted to record, reproduce, distribute, or share the content publicly without prior written consent.

7. Right of Withdrawal (Digital Content & Live Online Course)
Consumers generally have a statutory right of withdrawal of 14 days.

However, for this course, the right of withdrawal expires prematurely if:

  • the Customer expressly agrees that the Provider begins performance of the contract before the expiry of the withdrawal period, and

  • the Customer confirms that they are aware that they lose their right of withdrawal once access to the digital content is granted.

Access to the course content (including live sessions and/or recordings) is provided immediately after booking or before the withdrawal period expires.

By completing the purchase, the Customer agrees to this and acknowledges the loss of the right of withdrawal.

8. Liability
The Provider is fully liable for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.For slight negligence, liability is limited to foreseeable damages typical for the contract.No liability is assumed for lack of individual success or results.

9. Responsibility of the Customer
Participation in the services is at the Customer’s own responsibility.The Customer agrees to take care of their physical and mental well-being and to seek professional medical advice where necessary.

10. Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.For consumers, mandatory consumer protection regulations of their country of residence remain unaffected.

11. Dispute Resolution
The European Commission provides a platform for online dispute resolution:
https://ec.europa.eu/consumers/odr The Provider is not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Cancellation Policy (Information)
Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day the contract is concluded.To exercise the right of withdrawal, the Customer must inform:

13. Consequences of Withdrawal
If the Customer withdraws from the contract, all payments will be refunded within 14 days. If the Customer has requested that the service begins during the withdrawal period, a proportional amount for services already provided may be charged.

14. Final Provisions
Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
